Below you will find our standard terms and conditions. We’ve done everything we can to make our terms of service clear, honest and excellent value, so you won’t find any complicated mumbo jumbo or “legalise”. We’re just trying to cover our backs from the few unscrupulous people who would try to rip-off our designs or abuse our excellent service.

By using any of our services, you implicitly accept the following terms and conditions:
Our promise:
We promise to set-up a new test website and incorporate your supplied content, words, images and logos so you can see everything and try it out before you commit to anything. If you don’t decide to go ahead, we’ll wonder why but wish you well & it won’t cost you a penny.
If you do decide to go ahead (and we hope you will) and elect to use our “pay as you go” service, we also agree to provide support and assistance for one site alteration / update per month. We will also provide regular site traffic / statistical reports, carry out regular site back-ups and offer freely-available technical and design assistance as required.
Once you are happy with your website we will invite you to choose a payment option. You may choose to buy your site outright for a one-off payment, or use our “pay as you go” service for as long as you wish. With “pay as you go” there is no minimum contract and you have the right to cancel at any time.
Hosting and domain registration:
Every web site on the internet requires a registered domain name and a web site host to store your site files. This isn’t an “extra hidden charge”. Like line rental it’s just a fact of life. You are encouraged to choose your own hosting supplier and domain registrar. Many hosting companies include your domain name registration service for free. Commonly available hosting costs currently start at around £2.50 per month, depending on your provider. Like broadband providers, prices vary so shop around for the best deal. We can supply advice and recommenations on request so please ask us if you’re not sure. It is you (the customer’s) responsibilty to ensure your supplier’s services meet our following basic minimum requirements: PHP5, 1 database and an FTP facility.
If you already have a web site (you own a domain name and have a hosting contract in place), please ask us to check your arrangements are suitable for our requirements. You’ll need to supply us with the company / package / hosting plan you are on, along with your ftp access and existing database details. Your current provider should be able to supply these details on request if you don’t have them handy.
Your domain registration and hosting package agreement is between you and your chosen supplier. We cannot (and will not) be responsible for any problems or losses you may have with their services.
You are free to change your hosting arrangements at any time, and we will do everything we can to assist you with this. However we cannot guarantee the continuity of your services.
Design License:
By using our services you are purchasing the right to use our web site layouts, designs and design experience.
All our designs, design components and any content we may have created on your behalf remain the copyright of Speedypancake or their respective owners. If you elect to buy your site outright, you are purchasing a license to own and publish one copy of the design. Again, legal copyright is retained by Speedypancake. You may not under any circumstances duplicate or re-sell any of our designs, design input or content.
Payment terms:
By using the “pay as you go” service, you agree to set up a direct debit or standing order for the current monthly fee agreed. While we do not anticipate the need to do so, we reserve the right to adjust the monthly fee rate at any time. In this event, we will attempt to notify you by email two months in advance.
The agreed monthly fee is payable at the beginning of each month, one month in advance. If you fail to make a payment, we will contact you seeking a reason why. If we do not hear from you within 7 days your services may be suspended for 1 month. If you have not contacted us by the time your next payment is due we will assume you no longer require our services and your account, web site and content may be deleted.
Your responsibilities:
You (the customer) is responsible for all content on your web site, including any comments published on your site. If we feel any of your content is; likely to cause offense, libellous, pornographic, criminal or inciting a criminal act, misleading or deceptive, we reserve the right to remove such content and suspend your service at any time. At our discretion, your account may be terminated and the relevant authorities informed.
You are also responsible for the security of any private data or customer details you store on your site / web host / servers.
You agree to inform us about any changes in your hosting arrangements, company ownership and business address.
As part of your contract with us you agree to take all reasonable steps to keep your site login and password details safe and secure. “Pay as you go” customers must also agree to Speedypancake maintaining a “master login” and FTP access for the purposes of site maintenance, problem-solving, backups and statistical reporting.
WordPress:
Our designs are based on “WordPress” - the world’s leading content management system. WordPress and any assosciated “plugin modules” are freely available for anyone to install and use. This popular system has been tried, tested and proven to reliable, secure and effective. However, we cannot guarantee that any changes to the WordPress software or its terms of use made by the publishers of WordPress and their assosciates, or that any site modifications made by the customer or by Speedypancake on the customer’s behalf will not affect the costing, function or reliabliltiy of your web site.
Technical Problems:
In the event of a technical problem with your web site, please contact our support directly by email in the first instance. While our responsibilty for techncial issues is limited, we will investigate any problems and attempt to resolve them. In the unlikely event we are unable to resolve an issue, you may request cancellation of our services. We may, at our sole discretion, agree to a full or pratial refund for any service agreement that remains outstanding. Any such refund will be limited to the maximum value of one monthly payment.
Cancellation:
As a “pay as you go” customer you are free to cancel our services at any time. Please inform us in writing or by email if you wish to do so.
If you intend to replace your web site, we may, at our discretion, make your site content, images, database and backups (minus any of our propriety design input) available for transfer to your new site for a changeover period of four weeks following our receipt of a cancellation request.
Your right to buy:
If you are already on our monthly “pay you go” service, you are free to purchase your web site outright for a one-off fee at any time. You may also decide to purchase your site from the start. By buying your site, full control is automatically transferred to the purchaser and our “master login” and ftp access will be deactivated. You then assume full responsibilty for the management, technical backup, updating and upkeep of your site. We may continue to offer a limited technical advice service at our discretion.
